Terms and Conditions (T&C) of Galerie Newman by Newman 360° GmbH

1. Scope
These Terms and Conditions apply to all contracts, sales, and services between Galerie Newman, operated by Newman 360° GmbH (hereinafter referred to as “the Gallery”), and its customers – both in-store and via the online shop at www.galerie-newman.de.
2. Subject of the Contract
The Gallery offers artworks by various artists for purchase, either on-site or online. Additional services such as art consulting, framing, or mediation may also be provided.
3. Conclusion of Contract
(1) In-store purchases are concluded by acceptance of an offer or by signing a written agreement.
(2) In the online shop, the contract is concluded when the customer places an order and the Gallery confirms it via email.
(3) Reservations or inquiries are only considered binding once confirmed in writing.
4. Prices and Payment Terms
(1) All prices are in euros (€) and include applicable VAT.
(2) For online orders, the prices displayed at the time of the order apply.
(3) Payment is due immediately upon order or contract conclusion and may be made via bank transfer, card payment, PayPal, or any method offered in the shop.
(4) Retention of title: The artwork remains the property of the Gallery or the respective artist until full payment has been received.
5. Delivery, Shipping & Pickup
(1) Artworks can be picked up at the Gallery or shipped if ordered online.
(2) Shipping costs are displayed separately during checkout.
(3) Shipping is at the customer’s risk; insurance is available upon request.
(4) Delivery times (minimum of 1 week) vary depending on the artwork and production time (e.g., for art prints) and will be communicated in advance.
6. Right of Withdrawal & Returns (Online Shop Only)
(1) There is no right of withdrawal for custom-made, personalized, or limited edition artworks (§ 312g para. 2 no. 1 BGB).
(2) For non-customized merchandise (e.g., posters, t-shirts, accessories), the statutory 14-day right of withdrawal applies.
(3) Return shipping costs in the case of withdrawal are borne by the customer.
7. Warranty & Liability
(1) The statutory warranty for defects applies.
(2) The Gallery assumes no liability for damage caused by improper handling.
(3) Special conditions may apply to used or restored artworks, which will be disclosed in writing prior to purchase.
8. Copyright
(1) The copyright for all exhibited and sold artworks remains with the respective artist.
(2) Reproduction, distribution, or commercial use is not permitted without written consent from the copyright holder.
9. Data Protection
The Gallery processes personal data only in accordance with the GDPR.

10. Final Provisions
(1) German law applies; the UN Convention on Contracts for the International Sale of Goods is excluded.
(2) Place of jurisdiction is Berlin, if legally permissible.
(3) If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
